Friday last Governor Scott signed legislation changing the burden on Florida’s stand your ground law.
Used to be, the Defense would have to show that one was using a firearm in self defense, either at trial, or usually at a pretrial hearing. That is, you would have to show that “…[you] reasonably believe[d] that such force is necessary to prevent imminent death or great bodily harm to himself or herself, or another or to prevent the imminent commission of a forcible felony.”
With this law, the State now has that burden. That is, instead of the Defendant being affirmatively required to prove that he, or she, “reasonably believed” the state now has to prove that they did not.
Some 24 states have a stand your ground defense. I am not aware of any that shift the burden. In fact, I think Florida is the first, which is significant.
Not something some saw coming with all the “collusion” going on. Blame the Russians.
So, lessee, two months before flying from wherever to Florida, checking a firearm (which thousands of law-abiding people do, every month/day), and then shooting up an airport, this guy was telling the FBI that he was delusional, hearing voices, and was going to “fight for isis.” And had an apparent history of domestic violence? Really?
Some say that government is full of bureaucratic incompetents. I’m inclined to agree.
Oh, the Horror!
Wish UPS would deliver to my house. (Of course I would return it….).
In any event, some family was reportedly “horrified” when UPS mistakenly delivered an “assault rifle” to their home in New York.
Another example of the left and left-media hyping up a narrative to suit their purpose – it was not an assault rifle. The rifle (oh, but wait, if it was dark colored and evil looking, with a “shoulder thingy that goes up…“) was apparently a bolt-action rifle. Or worse, that it was – OMG – A BARRETT 50 CALIBER SEMI AUTOMATIC ASSAULT RIFLE!?!
Yet media outlets reporting the story are using stock images to pander their story. As seen here, here and here.
This, is a link to what may be the actual rifle. Not only is media hyping this story, but apparently, the guy who received it in error was not that much “horrified:”
“Wow, I should have kept the sucker,” said Joel Berman, 66.
So, “Horrified Couple receives assault rifle” becomes “Horrified Couple receives rifle”, becomes “Couple receives rifle. And Liberal Media Sucks.”
Good grief. What a bunch BS…. .
Keeping guns out of the hands of dangerous people saves lives. And expanding Brady background checks to every sale is the best way to stop dangerous felons, domestic abusers, fugitives, and terrorists from buying guns.
Wait, I thought guns were banned in the UK?
Hichem Ben-Abdallah, the owner of a nearby restaurant, said he saw a ‘river of people’ come screaming down the road after the attack.
He told The Yorkshire Post: ‘A lady was down on the floor. The man pulled a gun – it was a makeshift gun, not like something you see on television.
‘After the second shot I turned and ran. He walked away very calmly, down the steps. Nobody stopped him – he had a gun.’
